Baggage:
Baggage will not be checked. Personal baggage and other
paraphernalia necessary for the purpose of the trip and limited to the capacity
of the vehicle will be transported in custody of the passenger at no additional
charge.
Claims:
The company will not be liable for delays caused by
accidents, breakdowns, bad conditions of the road, snow storms, or other
conditions beyond its control, and does not guarantee to arrive at or depart
from any point at a specific time. All claims for damage of whatever
character must be filed, in writing at the nearest office or agency of this
company within six months.
Objectionable Persons:
This company reserves the right to refuse to transport a
person who, in the carrier's judgment, is under the influence of intoxicating
liquors or drugs or who is incapable of taking care of himself or herself or
whose conduct is such as to make him or her objectionable to or a danger to
other passengers, the driver or the vehicle. EXCEPTION: The above
rule does not apply to persons who are ill, and accompanied by an attendant or
nurse.
Liability For Delays:
(a) The carrier will not be liable for delays caused by
the Act of God, public enemies, authority of Law, quarantine, perils of
navigation, riots, strikes, the hazards or dangers incident to a state of war,
accidents, breakdowns, bad conditions of the road; snow storms and other
conditions beyond its control, to maintain the schedule submitted by its agent
or employee, but is not guaranteed.
(b) If an Act of God, public enemies, authority of Law,
quarantine, perils of navigation, riots, strikes, the hazards or dangers
incident to state of war, accidents, breakdowns, bad conditions of the road,
snow storms, and other conditions beyond its control make it, in the
opinion of the carrier, inadvisable to operate vehicles either from the place of
origin or any point of enroute, the carrier shall not be liable therefore, or be
caused to be held for damages for any reason whatsoever.
Reservations and Cancellation of Charter Trips:
All reservations for charter trips must be presented to the
carrier not later than 24 hours prior to the charter trip to avoid being subject
to the availability of equipment.
All requests for charter trip cancellations presented to the
carrier at least one week prior to the dispatch time from the equipment point
will be subject to a 50% refund of charter trip fare or a minimum cancellation
charge of $50.00, whichever is greater. A charter trip cancellation
request must be confirmed in writing. Deposit refunds for charter trips
submitted to the carrier not less than 30 days prior to the dispatch time from
the equipment point will be refunded 50% of the deposit.
Damage To Passenger Vehicle by Charter Party:
The actual cost of repairs for any damage done to passenger
vehicle by charter party is to be paid by party chartering the vehicle.
